Is your sick leave policy up to date?

As of July 1, 2015, earned sick leave is a statutorily guaranteed benefit to Massachusetts employees. While much of the focus has been on small business owners who did not previously offer sick leave, the new law also put the onus on businesses that did provide that benefit to make certain their current policy meets the requirements of the new law.

“Sick leave policies can vary from company to company. Some allow employees to carry over sick time, others do not. The new law clearly defines the minimum requirements and should be cause for most businesses with 11 or more employees to review their policy,” said Elizabeth Caruso, an Associate at the law firm of Baker, Braverman & Barbadoro, P.C. in Quincy, Massachusetts.

The new law requires that all businesses with 11 or more employees will have to provide paid sick leave, while businesses with 10 or less employees will have to provide unpaid sick leave. Employees, both full and part-time, can earn sick leave at the rate of one hour earned leave per every 30 hours worked, up to 40 hours of earned time per year. Employees who are considered “exempt” from the overtime requirements under the Massachusetts Fair Wage Laws are considered to work 40 hours per week.

Employees will be allowed to carry over up to 40 hours of leave per year into the next calendar, but will not be allowed to take more than 40 hours of leave in any calendar year. Unlike vacation pay, employers will not be required to pay any accrued sick leave time to any employee when employment terminates.

“Employers who already offer an equivalent or better sick leave or paid time off policy that meets the minimum requirements of this law will not be required to amend their policy,” said Caruso.  “Employers who have entered into contracts, benefit plans, or collective bargaining agreements with employees must continue to honor those agreements for the duration of the agreed upon term.”

The Massachusetts Attorney General’s Office will be issuing rules and regulations regarding the interpretation and implementation of this law in the coming weeks. Additionally, the Attorney General’s Office will be required to issue an employee notice regarding sick leave rights that must be conspicuously displayed by employers. Employers are prohibited from retaliating against employees who utilize leave under this new law. As with other labor laws, the Attorney General’s Office will be charged with enforcement of the law.

Susan Molinari, Esq., an attorney at Baker, Braverman & Barbadoro P.C., recently completed training at The Political Asylum/Immigration Representation Project (PAIR), the premier provider of pro bono immigration legal services to asylum-seekers and immigrants unjustly detained in Massachusetts.

The training Molinari attended, entitled “Representing Minors: An Overview of Special Immigrant Juvenile Status”, focused on how to assist juveniles to gain protective status in state court and before the immigration service. It also offered strategies on how to work with minors and highlight available resources that minors can access.

“The immigration issue has been percolating for many years and there seem to be far more questions than answers. Thanks to the training I received at PAIR, we have a few more answers and can better represent the true victims of immigration reform, the children,” said Molinari.

Founded in 1989, PAIR is nationally recognized pro bono model that works to secure safety and freedom for asylum-seekers who have fled from persecution throughout the world and to promote the rights of immigrants unjustly detained. PAIR provides hope and a new beginning to asylum-seekers, torture survivors and immigration detainees.

“Even though we pride ourselves on Boston-caliber legal representation at fees you will only find outside the city, we realize not everyone who needs a lawyer can afford to retain one,” said Paul Barbadoro, a partner at the Firm. “Susan is one of several attorneys at our Firm who takes that to heart and will work pro bono for certain cases. Estate planning with Facebook? New “legacy” feature on Facebook raises questions

Facebook has served as a catalyst for school and family reunions; hook-ups and break-ups. With its newest creation, a legacy function, the social media site has, in a small way, entered the arena of estate planning. Or has it?

The new function enables users to name a person as their legacy for when they pass on. The Facebook legacy is empowered to essentially manage the deceased’s account. This can include such things as: writing a post to display at the top of the memorialized Timeline (for example, to announce a memorial service or share a special message); responding to new friend requests from family members and friends who were not yet connected on Facebook; and updating the profile picture and cover photo. The legacy also has the power to take down somebody’s Facebook page after they die.

“By now, we have all known somebody who has a Facebook page or is on some other social media site and has passed away. Facebook’s approach is proactive in that it enables people to essentially nominate a personal representative to manage for their Facebook page to a trusted family member or friend,” said Elissa Burton, an attorney at Baker, Braverman, & Barbadoro, P.C.

While running somebody’s Facebook site may not sound like estate planning, it does present significant responsibility to the legacy. Particularly when you consider that many Facebook users have been posting notes, images and videos to the site for five to 10 years.

“The legacy contact function raises some potentially intriguing scenarios for those who have created a will and/or have done some estate planning,” said Burton. “Does the designated legacy contact have superior authority over the decedent’s Facebook page than a personal representative named in the decedent’s will? It’s an interesting question.”

Burton adds, ““It is important for individuals to be aware that designating a legacy contact for your Facebook page does not equate to nominating a personal representative for your estate and is not a substitute for proper estate planning.”

Warren Baker, a partner at Quincy, MA-based Baker, Braverman & Barbadoro P.C. was recently reappointed as a trustee of South Shore Hospital’s Charitable Foundation. This marks seventh year Baker has served as a trustee for the Hospital’s Foundation.

In addition to being a trustee, Baker will serve as the co-chairman of the Foundation’s planning giving committee.

Baker is the leader of Baker, Braverman & Barbadoro, P.C.’s corporate practice, providing advice and counsel in the areas of business organization, tax, real estate, zoning and land use, estate and Medicaid planning, and intellectual property and licensing matters. In addition, he serves as corporate counsel to numerous business organizations of varying size and type, both profit and not-for-profit organizations.

Christopher Sullivan, a partner at Quincy, MA-based Baker, Braverman & Barbadoro P.C. was recently awarded the First Justices’ Award for Pro Bono Publico Excellence. He received this honor based on his commitment to pro bono publico legal assistance in furtherance of providing access to justice for the poor and low-income individuals across southeastern Massachusetts.

Over the past (time period), Sullivan has donated more than 1,000 hours of his legal services to individuals in Barnstable and Plymouth counties.

At the Firm, Attorney Sullivan assists clients in the areas of elder and Medicaid law, estate planning and administration, general probate matters, probate litigation, guardianships, conservatorships and adoptions, including representations of same sex families. He also advises and counsels clients on issues related to asset protection, probate of wills and contested estates, estate and tax planning matters.

Sullivan received his juris doctorate from Suffolk University Law School. He also holds a bachelor’s degree from the University of Massachusetts at Boston. Prior to becoming an attorney, Sullivan was a court clerk at the Norfolk Probate and Family Court. He is admitted to practice before all state courts in the Commonwealth of Massachusetts and State of New Hampshire.

“As a court clerk, I saw many people who were either underrepresented or had no representation at all. I vowed that when I became an attorney that offering pro bono services would be part of my practice. I’m proud of the fact I’ve been able to keep that vow. Being recognized for that effort with the First Justices’ Award is icing on the cake,” said Sullivan.

In addition to his pro bono work, Sullivan has been the chairman of the Bench Bar Committee at Norfolk Probate and Family Court since 1999. In that role, he has worked with the court and the Norfolk Bar Association to organize the volunteer Lawyer for the Day program at Norfolk Probate and Family Court, as well as Attorneys Representing Children (ARC), a volunteer program to represent the child in court proceedings such as custody etc.

Sullivan is also active in his hometown of Hanover, Massachusetts, where he is a volunteer with the Hanover Council on Aging, the Hanover Foundation for Educational Enrichment, and the Hanover Youth Athletic Association. In addition, he is a volunteer member of the Corporate Council of the Juvenile Diabetes Research Foundation and the Planned Giving Advocate for New England for the Juvenile Diabetes Research Foundation.

Canton resident Susan Molinari was recently hired as an attorney by Baker, Braverman & Barbadoro P.C., a dynamic full-service law firm with a team of attorneys advising individuals, businesses and families throughout Quincy, Braintree, the South Shore and metro Boston areas.

Molinari previously worked for the Firm as an Attorney 1999 to 2012. She returns to Baker, Braverman & Barbadoro, P.C. after working as the associate director of career services at New England Law. In her return to the Firm, Molinari will specialize in complex litigation cases, trials and appeals in the areas of business and commercial litigation, criminal defense, consumer protection, probate litigation, and zoning appeals.

“It’s absolutely wonderful to have Susan back with us,” said Paul Barbadoro, a partner at the Firm. He added, “She brings a breadth of experience to the table with civil cases and probate, which will not only benefit our clients but help in mentoring our younger attorneys.”

Molinari received her juris doctorate from New England School of Law.  She holds a Bachelor of Science degree in psychology from Providence College. Prior to her initial tenure with the Firm, Molinari worked for the Massachusetts Department of Social Services as a social worker.

Molinari was admitted to the Massachusetts Bar in 1999. She’s also a member of the United States District Court, District of Massachusetts, admitted in 2000. A member of the Boston Bar Association, Molinari also volunteers legal services at Riverside Community Care in Dedham, MA.

Berton comes to the Firm from Seegel Lipshutz & Lo LLP where she worked as an associate attorney with a concentration on estate planning, tax preparation and trust administration. Baker, Braverman & Barbadoro P.C., a dynamic full-service law firm with a team of attorneys advising individuals, businesses and families throughout Quincy, Braintree, the South Shore and metro Boston areas, recently added Lunch ‘n Learn sessions to its speaker’s bureau offerings. The Firm had previously announced a Speaker’s Bureau, consisting of Baker, Braverman & Barbadoro, P.C. attorneys, to speak at events for professional as well as civic organizations.

“The Lunch ‘n Learn sessions, which will typically take place during lunch hours, involve our attorneys visiting local businesses to speak for about 30-45 minutes on legal topics that directly impact their staff and business,” said Paul Barbadoro, a partner at the Firm. “One of the first topics we would like to offer to speak to local businesses about is the recently passed ballot question 4.”

Ballot question 4 would allow workers to earn one hour of paid time off for personal illness or medical appointments, for an illness in the family, or to deal with a domestic abuse situation for every 30 hours worked. Employees will not be able to earn more than 40 paid hours per year. The law, passed by voters on November 4, will go into effect in July 2015.

“This law is a game changer for a number of smaller businesses,” said Barbadoro. “The Lunch ‘n Learn sessions can give business owners and staff an overview of what the new law will mean.”
