Estate planning with Facebook? New “legacy” feature on Facebook raises questions

Facebook has served as a catalyst for school and family reunions; hook-ups and break-ups. With its newest creation, a legacy function, the social media site has, in a small way, entered the arena of estate planning. Or has it?

The new function enables users to name a person as their legacy for when they pass on. The Facebook legacy is empowered to essentially manage the deceased’s account. This can include such things as: writing a post to display at the top of the memorialized Timeline (for example, to announce a memorial service or share a special message); responding to new friend requests from family members and friends who were not yet connected on Facebook; and updating the profile picture and cover photo. The legacy also has the power to take down somebody’s Facebook page after they die.

“By now, we have all known somebody who has a Facebook page or is on some other social media site and has passed away. Facebook’s approach is proactive in that it enables people to essentially nominate a personal representative to manage for their Facebook page to a trusted family member or friend,” said Elissa Burton, an attorney at Baker, Braverman, & Barbadoro, P.C.

While running somebody’s Facebook site may not sound like estate planning, it does present significant responsibility to the legacy. Particularly when you consider that many Facebook users have been posting notes, images and videos to the site for five to 10 years.

“The legacy contact function raises some potentially intriguing scenarios for those who have created a will and/or have done some estate planning,” said Burton. “Does the designated legacy contact have superior authority over the decedent’s Facebook page than a personal representative named in the decedent’s will? It’s an interesting question.”

Burton adds, ““It is important for individuals to be aware that designating a legacy contact for your Facebook page does not equate to nominating a personal representative for your estate and is not a substitute for proper estate planning.”

Putting green practices into practice…Tarlow Breed Hart & Rodgers P.C. accepted into Sustainable Business Leader Program; becomes a “leader” in sustainable business practices initiative.

Despite the explosion in the use of digital information, the legal industry continues to consume too much paper. As a profession, far too many lawyers believe that more words are better and that everything must be printed multiple times just in case. In an effort to change this behavior and reduce its carbon footprint, Boston-based Tarlow Breed Hart & Rodgers, P.C. (TBHR) recently implemented a sustainability program developed with Boston Redevelopment Authority (BRA) and Mass Department of Environmental (DEP)’s Sustainable Business Leader Program (SBLP).

TBHR’s program was developed as a result of SBLP’s comprehensive audit, which focused on six key areas: waste reduction, water and energy conservation, transportation solutions and pollution prevention.  The Firm created a “Green Team” of attorneys and staff to develop achievable changes to challenge all personnel to take a moment to think before they consume.

Says Michael Radin, an attorney with the Firm and Green Team member, “Our firm culture is rooted in an appreciation of the interdependencies of what each of us does.  If we want to have a good tomorrow, each of us needs to act for it today.”

“When the program opened to us, we jumped on the opportunity,” says Jennifer A. Civitella Hilario, an associate who like many of her co-workers tries in her personal life to reuse, recycle and reduce waste.  “Applying my own personal conservation practices at the office helps me to get an entire organization to consume less – I am thrilled.”

Some of the steps THBR has taken include electrical energy management and water and kitchen paper use reduction. “I much prefer using a mug given to us by one of our clients,” adds Radin

“What’s been an enlightening part about this process is the need to educate others on the lots of little things we can do that together have a huge impact,” said Civitella Hilario.  “Thanks to SBLP and our Green Team, we’re a greener company and have a group in place actively looking for ways to improve the efficiency of our energy use.” 

As part of the SLBP audit, TBHR engaged with its landlord Boston Properties which itself has a team of professionals working to get tenants focused on ways to be more efficient and less wasteful.  “Working with Boston Properties was fabulous – they really reached out to us and together we are planning to approach our entire building to get other tenants involved,” adds Civitella Hilario.

The SBLP was formed in 2008 via collaboration between the DEP and the BRA. SLBP has worked with more than 60 businesses to become sustainable leaders in the community.  Each business completes SBLP’s rigorous assessment and receives personalized technical assistance over a six-month period before becoming eligible for the Sustainable Business Leader status.

Never too old to adopt…Tarlow Breed Hart & Rodgers P.C. helps play Santa for New England Center for Homeless Veterans’s “Adopt a Vet” program.

We all have our wish list when it comes to gifts we’d like to receive for Christmas. The residents of the New England Center for Homeless Veterans, located at 17 Court Street in Boston, are no different—only that list contains some of life’s necessities, like warm clothing for the winter. As part of the Center’s “Adopt-a-Vet” program, Boston-based Tarlow Breed Hart & Rodgers, P.C. (TBHR) helped make the wishes of two dozen homeless veterans come true.

 

The Adopt-a-Vet program involves each resident drafting a list of items he or she would like to receive for Christmas. Donors are then asked to purchase and wrap gifts from that list to be given to the residents for Christmas. More than 20 members of TBHR’s staff contributed gifts to this year’s program, enabling TBHR adopted shelter residents to check off every item on their wish lists.

 

“This is such a worthwhile program on so many levels. When our car pulled up, the Shelter volunteers were ecstatic!” said Jennifer A. Civitella Hilario, a lawyer at TBHR who volunteers her time at the Center and who coordinates the firm’s participation.  “What makes it even more worthwhile is that the donations and contributions from our firm and other companies and individuals made it possible for every veteran who participated to receive most of the items on their lists.”

 

Items contributed to the Adopt-a-Vet program include:

Tarlow Breed Hart & Rodgers P.C.’s Christopher Hunt presents at IT conference.

Christopher Hunt, director of information technology at Boston-based Tarlow Breed Hart & Rodgers, P.C. (TBHR), recently presented at the International Legal Technology Association (ILTA) 2009 Annual conference, held at the Gaylord National Resort in Maryland from August 23-27, 2009.

Hunt spoke at the session entitled “Mobile Device Management: Can You Afford (Not) to Go It Alone?” as part of the Mobile, Remote & Wireless Technologies Peer Group track of the conference. He was one of three speakers on the panel for the session and acted as moderator, leading the discussion and also presenting information specific to TBHR.

“The utilization of wireless technology is critical for most businesses nowadays but even more so for law firms, as our attorneys spend quite a bit of time outside the office but still need to be connected and accessible,” said Hunt. “Attending and presenting at the ILTA was a great opportunity to not only share my expertise but to learn more about how other firms utilize wireless technologies and how they enforce policies and procedures towards the use of those technologies.”

Established more than three decades ago, ILTA provides its members—consisting of IT professionals employed by in-house legal departments or law firms–educational content and peer-to-peer networking opportunities. This includes events like the annual conference, webinars, teleconferences, seminars, regional and international events, white papers and much more.

A graduate of Northeastern University, Hunt began with TBHR in 1995. As part of his role as director of information technology, his responsibilities include utilizing the firm’s IT for litigation support, marketing support and facilities management.

Hunt resides in Lowell, Massachusetts with his wife Jodi and his stepson Brendon.

How keeping track of your employees is as simple as issuing a company phone.

Over the last few years, use of company-owned property by employees, such as vehicles and cell phones containing GPS devices, has become more widespread.  While not the primary use of this property, it does enable an employer to track the whereabouts of the employee (or at least the company property) both during and after normal business hours.  In its business law practice, Boston-based Tarlow Breed Hart & Rodgers, P.C. (TBHR) has advised employer clients on the legalities of keeping tabs on their employees and offers some insights on the topic.

Cell phones contain GPS tracking capabilities for ‘911’ calls so that police, fire and other emergency services can trace a call to a general area.  In recent years, as cell phone technology has improved, it’s given the user the capability to turn the tracking device off. Yet how many users even know their cell phone can be used as a GPS device to monitor their movement?

“With e-mail and Internet use, employees generally accept that their employer can keep tabs on what they’re doing and employee handbooks usually contain distinct language regarding that policy. And if the employer provides an employee with a cell phone, it is generally understood that an audit of the employee’s calls could be conducted by the company.” said Stephen Kutenplon, partner at TBHR. “Yet when it comes to actually monitoring an employee’s whereabouts, including time away from the office during non-business hours, employers have to walk a fine line between legitimate business purposes and violating an employee’s right to privacy. However, a clearly stated company policy can eliminate an employee’s expectation of privacy, certainly during company hours.”

This is a new and developing area of the law, and very few cases have been decided. In Pemberton v. Bethlehem Steel Corp., the Maryland Court of Special Appeals held that an employer could observe, film or record the activities of an employee to ascertain the truthfulness of job-related workers compensation claims. To lessen the chance of an employee making a successful claim that the employer monitoring or use of the GPS results violated privacy rights, there are a few steps the employer should take:

  • Only install the GPS device in company-owned property
  • Inform the employee of the monitoring and obtain the employee’s written consent (consider conditioning use of the company property on the employee providing consent)
  • Limit the intrusiveness of the information collection and use (such as by  keeping confidential and not using any information obtained related to non-work time or activities [e.g. doctor office visits])
  • Recite in the policy the company’s interests in adopting the monitoring, which could be employee efficiency and productivity, easily locating the company vehicle fleet, and safety.      

“This is a difficult balancing of interests. If an employer feels it is in the best interest of the company to monitor its staff out in the field using a GPS device in company-owned cell phones or vehicles, then that policy should be clearly stated in the employee handbook.  The employee should also consent in writing to the policy prior to the company providing the company property equipped with a GPS device,” says Kutenplon.

How to keep your blog out of the courtroom

Businesses and individuals create blogs for a variety of reasons – to demonstrate their expertise on a particular topic; improve search engine rankings for their Web site; sell a product or service; or just to create a forum to express opinions.  No one, however, starts a blog with the intent of being sued. Yet, according to Boston-based Tarlow, Breed, Hart, & Rodgers, P.C. (TBHR), the potential for a lawsuit arising out of your blog is real and greater than you may realize.

“When it comes to a blog, where you get your material and how you use it can land you in hot water just as much as, if not more than, what you say.  Using unauthorized photos, failing to properly credit a source you quote, using copyrighted material, or allowing comments that contain any of the above can open the door to a lawsuit. That’s not why most people start blogs,” said Emily C. Shanahan, an associate at TBHR.

There are some steps you can take to help ensure your blog sticks to its intended purpose without making you or your company vulnerable to a lawsuit:

  • Screen comments on your blogs – Stay in control of the content of your blog either by not allowing comments or by clearly defining from the outset what standard posted comments have to meet.  If they don’t, delete them.  That being said, don’t play editor of your users’ comments.
  •  If you quote them, give them credit – Trying to pass off somebody’s words as your own can lead to big trouble. If you’re going to quote somebody, keep it short and always credit the person who said it and in what publication. 
  • Using photos and images – Just because you find an image on the Internet does not mean you have permission to use it. When it comes to artwork, use only what you create, own the license for, pay to use or know to be free stock photography or clip art.
  •  Celebrities – While using celebrities as fodder for your blog might make for entertaining content, it could open the door to a defamation lawsuit if you’re not careful. Even associating a celebrity’s name and/or image with your blog in a positive manner can lead to trouble down the road if you don’t have his or her permission.
  • Company trademarks – Do not use in your blog trademarks that you do not own or are not licensed to use. You can, however, mention another company by name. As a precaution, you may want to mention if the company’s name is trademarked.

Tarlow Breed Hart & Rodgers P.C.’s “super six” selected as Rising Stars in Boston Magazine’s attorneys “Super Lawyers” issue

As part of the Massachusetts Super Lawyers segment in its November 2008 issue, Boston Magazine recognized six attorneys from Boston-based Tarlow Breed Hart & Rodgers, P.C. (TBHR) as “Rising Stars”.  Those selected include:  Perry Ganz, a partner in the firm who resides in South Natick and who was previously named Rising Star in 2007, and five of the firm’s associates, Jennifer A. Civitella Hilario, of Somerville; John D. Finnegan, of Pelham, New Hampshire, previously named in 2005, 2006 and 2007; Karen L. McKenna, of Scituate, previously named in 2007; Terrence M. Schwab, of Natick; and Emily C. Shanahan, of Wellesley.

Rising Star selections are based on a statewide survey of more than 37,000 attorneys.  Candidates are also evaluated based on peer recognition and professional achievement and then grouped and ranked by practice area.  Those with the highest point totals are selected.

“We put a lot of time and effort into the attorneys who join the firm.  We not only look for intelligence and creativity in legal skills, but quality people.  So, it’s quite gratifying to watch the young professionals we bring in earn this kind of recognition,” said Richard P. Breed, a member of the firm’s management committee.
